STATUTES

I. Name and seat

Article 1 The International Federation of Sports Chiropractic (F.I.C.S.) is an association in the senses of articles 60 and following of the swiss civil code.

The F.I.C.S. is politically and confessionaly neutral and rallies to principles fundamental of the Swiss democracy , as well as to rules not discriminatory extolled by the International Olympic Committee (I.O.C.).

Its seat is in Paris.

 

II. Goals and tasks

Article 2 The goas of the F.I.C.S. is the maintenance, the application, the promotion of sports chiropractic, and the safeguard of professional interest common and general of doctors in sports chiropractic. Critical to F.I.C.S. is the acknowledgement that this is en independent health profession ,

The goals shall be obtained through:

a) the representation of the chiropractic profession and the conduct of relationships between it and the sports authorities, other health professions and public or private institutions;

b) the recognition and respect of its professional status of independent healthcare profession in the area of sport;

c) the adaptation of its status at its level of academic education;

d) the gain of equitable prerogatives that implies this status;

e) the correction of texts and equivocal informations;

f) the information of authorities and the public about sports chiropractic;

g) the maintenance of the ethical standards in sports chiropractic by the use and respect of codes of ethics within the profession;

h) the promotion of academic teaching of sports chiropractic and the encouragement of its study;

i) the establishment and the maintenance of bonds of good collegiality between its members;

j) the assistance for itsmembers in all opportunity, by its advice as well as its moral and effective support;

k) the adherence of its members to their respective national sports association.

 

 

III. Affiliation

Article 3 The F.I.C.S. is composed by ordinary members, associate members and honorary members.:

a) Ordinary Members:

All national sports chiropractic associations (called National Chiropractic Sport Council - N.C.S.C. ) can become ordinary members. Each national sports chiropractic association has to delegate one of its members to the General Assembly. Individual members of these associations have also to be member of their respective national chiropractic association. Their individual members are distributed according to the following classification: individual members A1 (IFM = Individual Full Members); individual members A2 (IM = Individual Members). The classification is defined by a internal regulation of the F.I.C.S.

The ordinary members (N.C.S.C.) have right to one vote (between 1 and 100 members) or to two vote (101 members and more).

b) Associate members: Physical and moral persons (belonging to the chiropractic profession) that are interested in the goals of the F.I.C.S. can ask for admission as associate members. The associate members have no voting rights.

c) Honorary members: All individuals having worked in the interest of public health and particularly in the area of the sports chiropractic can be appointed as honorary members by the General Assembly as proposed by the Executive Council. Honorary members participate ad libitum in the activities of the F.I.C.S. and are exempted of contributions.

 

Article 4 Applications for admission are to presented in writing at the Executive Council. Admission is approved by the General Assembly.

Resignations have to be presenting in writing to the Executive Council at the latest one month prior the end of the annual exercise. They can only be accepted if the resigning member has fulfilled of all financial obligations of the current year.

F.I.C.S. members will be excluded if found to participate in the following:

• Acting against the interest of the F.I.C.S.,

• Failure to pay dues despite reminders,

• Continual failure to participate in the General Assembly, despite writing warning.

Members will be excluded upon proposal of the Executive Council, by a majority vote of the ordinary General Assembly (majority = 2/3 participating members that have voting right) and will be done by secret ballot.

Members concerned have to be informed in writing .

Members that have been excluded are responsible of possible obligations towards the F.I.C.S.. They lose all benefits of the F.I.C.S..

 

IV. Rights and duties of members

Article 5 Effective participation to the activities of the F.I.C.S.;

• Voting right of the ordinary members, members of the Executive Council and honorary members during the General Assembly;

• - Reception of informations concerning activities of the Executive Council and representatives of the F.I.C.S.;

• - Reception of statutes of the F.I.C.S. and the code of ethics by each new member ;

• - Respect of the code of ethics;

• - Punctual payment of annual dues, which amount is fixed by the General Assembly on proposal of the Executive Council;

• - Obligatory participation to the General Assembly ; only in case of emergency, absence is justified. The Executive Council has to be informed in writing .

 

IV. Droits et devoirs des membres

Article 5 Participation effective aux activités de la F.I.C.S. ;

• Droit de vote des membres ordinaires, des membres du Conseil Exécutif et des membres dhonneur aux assemblées ;

• Réception des informations concernant les activités du Conseil Exécutif et des représentants de la F.I.C.S. ;

• Réception des statuts de la F.I.C.S. et du code de déontologie par chaque nouveau membre ;

• Respect du code de déontologie ;

• Paiement ponctuel des cotisations annuelles, dont le montant est fixé par lassemblée générale sur proposition du Conseil Exécutif;

• Participation obligatoire à lassemblée générale ; seul un empêchement en cas de force majeure constitue une absence justifiée. Le Conseil Exécutif doit en être informé par écrit.

V. Organization

Article 6 The administrative year is defined as the year between two ordinary General Assemblies. On the other hand, the financial year starts on the January 1^st and ends December 31^st.

Article 7 The bodies of the F.I.C.S. are :

1. the General Assembly (G.A.),

2. the Executive Council (E.C.),

3. the headquarters,

4. auditors of accounts.

Article 8 The General Assembly (G.A.)

The General Assembly is the supreme body of the association. It is summoned to demand of the president, the Executive Council or a third of the ordinary members. Except emergency, the convocation to the meeting has to be sent to members at the latest 60 days before the meeting.

The participation to the General Assembly is obligatory for all the ordinary members. Members excused can delegate their vote by written proxy only on objects defined in the agenda of the General Assembly.

Decisions of the General Assembly are valid to the simple majority of the ordinary member.

The General Assembly processes the totality of businesses interests of the association. It ratifies regulations and conventions on proposal of the Executive Council. It ratifies proposals of admission, resignation and exclusion of members.

The General Assembly can delegate authorities by mandate specified to delegates or to commissions.

The ordinary General Assembly is summoned once by year.

The agenda is composed as follows:

1. list of presences

2. approval of the report of the last General Assembly

3. approval of reports:

1. report the president

2. report of the secretary general

3. report of the general director

4. report of representatives of commissions

4. mutations (admissions, resignations and exclusions)

5. annual accounts and budget

1. report the chief of finances

2. report of auditors of accounts

6. fixing of the amount of annual contributions

7. elections,

1. the president,

2. the other members of the Executive Council,

3. auditors of accounts,

4. representatives beside sports authorities

5. honorary members

8. program of activity

9. possible modifications of statutes

10. proposals emanating from members; they have to be submitted to the Executive Council at the latest 90 days before the General Assembly

11. report of the NATIONAL CHIROPRACTIC SPORT COUNCILS

12. candidates for the future General Assemblies

13. varia

For businesses that would not have been announced, a decision can be taken only if there is emergency or when a preliminary information was not possible.

Article 9 The Executive Council

It is elected for four years by the General Assembly; its members are re-eligible at the end of their mandate. The Executive Council is composed:

1. a) the president

2. b) the 1st vice-president

3. c) the 2ème vice-president

4. d) the secretary general

5. e) the chief of finances

6. f) the general director

7. g) one assessor

It can be extended to two members, according to the needs of the association.

Each member of the Executive Council has right to one vote during the General Assembly.

The president is elected separately, then the other members are elected in blockwise. The Executive Council distributes duties between its members. Functions of the Executive Council is:

 

• to realize the goals of the F.I.C.S.

• to manage businesses that is attributed by statutes and decisions,

• to elaborate the annual program and to assume its realization,

• to establish the annual budget.

The Executive Council can make a decision when at least four of its members are present. For expenses, the Executive Council has a competence of an annual amount fixed by the General Assembly; expenses more important, not anticipated by the budget, have to be submitted to the approval of the next General Assembly. The president aims all invoices and justification papers.

 

Article 10 The headquarters

The headquarters insures the administrative functioning of the F.I.C.S. on mandate of the Executive Council. It is directed by the general director.

 

Article 11 Auditors of accounts

There are two auditors of accounts. The General Assembly elects an auditor all odd years. They are re-eligible at the expiration of their mandate. They can anytime take knowledge of the justification papers and the appearance of accounts. A fiduciary company can replace auditors of accounts.

They make a report on the appearance of accounts and their concordance with decisions of the General Assembly and statutory dispositions.

 

Article 12 Finances - Payment of contributions

Expenses of the F.I.C.S. are covered by contributions, donations and other possible incomes.

Annual contributions have to be paid at least until the end February. The chief of finances is in right to perceive contributions remained unpaid on that date by competent authorities.

 

Article 13 Responsibility

Commercial commitments of the F.I.C.S. are guaranteed only by the assets of the association; a personal guarantee of members is excluded.

The Executive Council commits the F.I.C.S. by the common signature of two of its members.

 

Article 14 Litigations

All litigations will be submitted to the Court of Arbitration for Sport in Paris (Switzerland), and sliced accordingly to the code of arbitration in the field of sport.

 

Article 15 Modifications of statutes

Proposals of modifications of the statutes can be processed only by the General Assembly; decision can only be made if more than half more one of the ordinary members are present and if there is a majority of two-third of voices of the members present with voting right .

Proposals of modifications have to be submitted in writing to the Executive Council 90 days at least before the General Assembly.

 

Article 16 Dissolution

A dissolution of the F.I.C.S. will not be pronounced as long as ten members will be committed to some insure its continuation.

In case of dissolution of the F.I.C.S., archives and its assets will be kept in deposit and managed by the FICS Foundation who will hold them to the disposal of a new association whose goals would be analogous. If no new association is founded during the ten years that follow the dissolution of the F.I.C.S., archives and its assets will be donated to the Foundation Pierre de Coubertin.

 

Article 17 The present statutes abrogate all previous statutes. They have been approved by the General Assembly of July 4^th,1998 in Paris. They enter immediately in force.

The french version makes faith.

 

MODIFICATIONS

These statutes were modified by the General Assembly held in paris (France) on 24 May 2001. The modifications came into force immediately.
